Online notarisation of powers of attorney
Published · Updated

Having a power of attorney (PoA) notarised online can speed up business processes by several weeks. We explain what a power of attorney is and what it is needed for here. Since powers of attorney are usually used when the grantor cannot or does not want to be physically present, it makes a lot of sense to set up a power of attorney online. In this article, we explain the advantages of having a power of attorney notarised online and how online notarisation works.
Advantages of an online PoA
Having a power of attorney notarised online has major advantages for both the grantor and legal advisors. To illustrate these advantages, the process of granting a power of attorney is briefly outlined in an example.
Example:
Without notarity: A person in South Korea (“John”) wants to set up a GmbH (limited liability company) in Austria. John does not want to fly to Austria to set up the company, so he decides to grant his lawyer a power of attorney for the formation of the GmbH. Such a power of attorney must be notarised. John therefore makes an appointment with a notary in South Korea and waits a week for it. After his signature on the power of attorney has been notarised, John makes an appointment at the Austrian embassy in Seoul. He gets an appointment in three weeks’ time and goes to the embassy to have an apostille added to the notarised power of attorney. He then sends the notarised and apostilled power of attorney by post to Austria, where the GmbH can be set up six weeks later.
With notarity: John’s lawyer is an innovative legal advisor who values services that save her clients time and money. She therefore suggests that John has the power of attorney notarised digitally via notarity. She books a digital appointment with a partner notary on notarity to notarise the power of attorney. John connects with the partner notary on notarity in a video call. The notarisation of the power of attorney takes one minute. The digital original is available shortly after the appointment and the GmbH can be set up in Austria.
