What a notarial deed is

A notarial deed (Notariatsakt) is the most formal kind of notarisation in Austria. In the appointment, the partner notary reads the whole deed aloud, explains the individual clauses and advises on potential risks, then records it as a notarial deed. Some Austrian matters require one instead of a simple signature notarisation, such as GmbH formations and share transfers. For most procedures, a signature notarisation is enough.

Pricing in Austria

A binding offer before the appointment

For Austrian matters, the partner notary first assesses your case and then sets the fee, so there is no fixed price upfront. You receive a binding offer with all costs, notary fee, notarity fee and VAT where applicable, and can accept or decline it.

What the notary needs for an offer

  • Your drafts, or a drafting request

Attach the documents if you or your lawyer prepare them, even if they are not final yet. Otherwise, say that the notary should draft them.

  • Who files

Whether the notary should file the documents with authorities or courts, or your lawyer does.

  • The number of signatories

Everyone who signs, so the offer covers the whole appointment.

Frequently asked questions

To the FAQ

What is a notarial deed (Notariatsakt), and when do I need one?

A notarial deed is a formal notarisation in which the notary reads the document aloud during the appointment and records it as a notarial deed. Some Austrian legal matters require one instead of a simple signature notarisation, for example GmbH formations and share transfers. Because it takes more time and involves greater legal responsibility for the notary, a notarial deed costs more.

What is the difference between a certification and a notarial deed?

In a certification, the document is not read out. The notary only confirms the identity of the signatories, that they know what they are signing and that they sign free from coercion. In a notarial deed, the entire deed is read out. The notary explains the individual clauses to the parties and advises on potential risks. Some transactions require a notarial deed, such as GmbH formations and share transfers. For most procedures, a certification is sufficient.

How do I get an offer from an Austrian notary?

Select Austria as the destination country and choose the service you need. Give as many details as possible: whether the notary should draft the documents or you provide them (please attach drafts, even if not final), whether the notary should file documents with authorities or courts, and how many people will sign. Your request is sent to Austrian partner notaries, and you receive an offer by email that you can review and accept.

Why can't I see a fixed price for appointments in Austria?

For documents used in Austria, you are connected with an Austrian partner notary, who first assesses your individual case and then sets the fee. That is why fixed prices cannot be shown upfront. You always receive a binding offer before the appointment.

How long does it take to get an appointment?

Appointments for online notarisation can be booked at short notice. Partner notaries need about one hour's notice to draw up a notarial deed. Appointments are available on weekdays between 7 am and 9 pm as standard, and outside these times by arrangement.

Can I have a will notarised online in Austria?

No. Under Austrian law, wills cannot be notarised digitally.
