The Packaging Ordinance in Austria is an important legal regulation that ensures that packaging is properly placed on the market in Austria and that the environment is not polluted by harmful packaging materials. The regulation is based on an EU directive and must therefore also be implemented in Austria. From the beginning of 2023, all foreign persons will need a Packaging Ordinance Authorisation.
Implementation of the Packaging Ordinance Power of Attorney in Austria
The EU Directive and thus also the regulations concerning the Packaging Ordinance Power of Attorney have been implemented and adapted in Austria. From 1.1.2023, according to these regulations, all foreign persons who place packaging on the market in Austria must appoint an authorised representative who is responsible for compliance with the packaging regulations (Packaging Ordinance Power of Attorney).
All foreign mail order companies that deliver directly to private end consumers in Austria must therefore appoint an authorised representative for packaging as of 1 January 2023. The Packaging Ordinance in Austria stipulates that from 1 January 2023 all foreign persons who place packaging on the market in Austria must appoint an authorised representative. This authorised representative is then responsible for compliance with the applicable packaging regulations and must be liable in the event of violations.
